Terms and conditions

Welcome to our website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern our relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.

The term ARM Furniture Ltd or The Bed Shop or ‘us’ or ‘we’ refers to the owner of the website whose registered office is  ARM Furniture Ltd, 81 Burton Road, Derby, DE1 1TJ. Our company registration number is 8595053.Our  VAT number 166453004.

The term ‘you’ or ‘Buyer’ refers to the user or viewer of our website.

The term "Special Items" or “Bespoke for You” means any Goods that are not held in stock by The Bed Shop and are ordered and/or manufactured specifically for you.

1.0       Please read all Terms and Conditions before making a purchase from this website. By purchasing from this website you are agreeing to be bound the Terms and Conditions below. Please note that these Terms and Conditions do not affect your statutory rights as a consumer.

1.1       The Bed Shop retains the right to refuse orders that may be subject to an error on its website and in these circumstances will issue a full refund.

1.2       Upon payment of your order, you will receive an order confirmation email outlining your purchased items, delivery address and financial details of your transaction. As this document forms your contract with The Bed Shop please ensure that all personal and order details are correct and inform us of any errors. If you do not receive an email after placing an order, please contact us immediately to confirm your details.

Limitations of Liability

2.0       Our total liability in regard to the performance of this contract shall be limited to the value of the Goods. 

2.1       The Bed Shop shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance/or non performance of this contract.

Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law.

2.2       All contracts shall be governed by English Law.

2.3       Any order placed by the Buyer and accepted by The Bed Shop is subject to the following terms and conditions unless specified in writing by a Director of The Bed Shop. A confirmation of your order will be sent by e-mail and, unless you are notified to the contrary within 48 hours of this confirmation, the order will be deemed to be accepted by The Bed Shop.  

2.4       The Bed Shop retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.

Description of goods

3.0       The description of the goods will be as specified within the confirmation e-mail and it is your responsibility to check that the Goods specified are as the Buyer intended to order. This includes but is not limited to colours, sizes and specifications.

3.1       Measurements provided on the website are for guide purposes only and may not be taken as exact. All products supplied are subject to a manufacturing tolerance of +/- 3%. The Buyer should ensure that the goods will fit into the delivery address and their intended space within the property.

3.2       Matching of colour shades from samples, fabric designs & wood veneers or natural products will be within a commercial tolerance but cannot be guaranteed nor will they match what is shown on screen exactly. Please contact us if you need clarification or more information, photos or fabric samples.

3.3       Goods manufactured from reclaimed wood may have holes, knocks and dints in the finish. These are intrinsic characteristics of reclaimed and natural wood and are not considered a reasonable reason for return.

3.4       Images of products on the website are for illustrative purposes only. For clarification on any particular item please contact us. Certain items included in the illustration of a product which are not part of the product and are not included in the product description and are not part of the order, (for example, headboards, shelf packs, drawer inserts, bedside tables, dining chairs lamps and bed covers).

3.5       In the event that a product is purchased from our website, but it is no longer available from the supplier, an alternative product will be offered. /If the alternative product is not satisfactory, The Bed Shop will issue a full refund.

Payment

4.0       Full payment is required at the time the order is placed unless otherwise agreed. We reserve the right to hold goods whilst payment clears.

Delivery

5.0       Delivery is carried out by experienced delivery drivers. We aim to use a 2 man delivery service for the large majority of our deliveries, however, small deliveries may be sent out via a 1 man service.

5.1       The delivery time scales stated on the web site are approximate only and The Bed Shop will not be liable for any loss suffered by you arising from any delay in the delivery of the product(s). Reasons for delay or non-delivery could be and not limited to: holiday periods i.e. Christmas, Easter; the delivery area is in an area of inaccessibility; or in any other causes whatsoever beyond our control.

5.2       Please note it is the customer’s responsibility to ensure access is sufficient to receive the product(s) of your choice. We recommend that you measure the space in which the products are to be placed, and the space along the access route especially if goods are for upstairs rooms. If we have to abort delivery due to insufficient access the customer will be liable to pay the direct cost of delivery along with the return charges to us with the exception of bespoke items which cannot be returned. 

5.3       Generally, where an order contains more than one item, all items will be delivered at the same time once all items are available unless otherwise agreed at time of order. 

5.4       The Bed Shop do not accept any blame or liability for customers removing or disposing of old beds, mattresses or sofas prior to delivery. We do advise that customers only dispose of old goods after acceptance of the new goods been delivered.

5.5           Deliveries made to business addresses will have the Buyers authority for anybody in the building to accept the goods on the customer’s behalf. The Bed Shop will accept no responsibility once the goods have been signed for at the requested address.

5.6          Goods will be deemed to have been delivered once delivered to the specified address. Delivery is officially to the front door only but Goods may be taken to the room of choice at Buyers request. It is also the customer’s responsibility to remove all paintings, mirrors or any other objects that may get damaged or that may hinder the product from going into the room of choice during delivery.

5.7       The Bed Shop or its carriers will not be held responsible for any damage caused to Goods, property, fixtures or fittings during delivery. If the customer is unwilling to accept this waiver the item will be left at the front door of the property. It is the Buyers responsibility to ensure all Goods will fit through any doorways and/or passageways necessary for Goods to be delivered into the room of choice.

5.8       Most Goods will require some form of assembly and it is the Buyer's responsibility to assemble the Goods unless otherwise agreed at time of order. Any Warranty/Guarantee offered with the Goods is only applicable for Mainland UK.

Faulty Goods 

6.0       Complaints relating to faulty Goods should be notified via email with supporting photographic evidence within 30 working days of the fault becoming apparent and should be addressed to sales@thebedshopleicester.co.uk    Please note that we always require photographic evidence.

6.1          Where Goods are reported as faulty later than seven days after delivery, we require photographic evidence of the fault. Where upon we shall make a decision: 1 – To replace the item like for like. 2 – Make an allowance for the final acceptance of goods. 3 – Arrange for an independent inspection. 4 – Refuse the claim. Or 5 – Refund the buyer and collect the item.

Cancellation of Goods

7.0         Please note that you have the right to cancel any online order within 14 days, unless the following applies:

7.1       Items which cannot be resold for health and hygiene reasons once unwrapped (for example mattresses, bedding, pillows, etc. that the product seal / bag has been opened). Flat pack furniture that has been partially or fully assembled. Bespoke items with customised sizes.

7.2         All "Bespoke items sold from this site will be specially ordered from the relevant manufacturer at time of order. These are goods which are not held in stock by  The Bed Shop. Please consider that all goods will need ordering from the manufacturer unless you have written communication (by email) to confirm that the goods are available from stock. Bespoke items cannot be cancelled once ordered and been accepted by The Bed Shop. Please take time to carefully check your order confirmation and report any errors by e-mail within 24 hours of receipt. 

7.3          All returns are subject to a collection charge, unless agreed otherwise.

Refunds

8.0           Once we have been notified of the cancellation of your contract, we will refund you in full within 5 working days if you are eligible for a refund. To establish eligibility, please see above terms and conditions.


Delivery Information

How much is delivery/collection

Collections are free of charge
Available 5 days a week (Tuesday to Saturday, 9:00am to 5:00pm) Collections will be made available from our store or warehouse location.

Once all your items are in stock, we will contact you to arrange collection.

Cost of deliveries

We charge £40 for deliveries within a 30 mile radius of our store. Additional delivery charges will be payable for distances outside of this radius which will be agreed prior to placing any orders where additional charges may apply.

 

We will deliver all of your items at the same time when possible. On some occasions we will dispatch products from different locations and this may cause them to be delivered on different days. We would only do this with your permission.

We use our own vehicles and a selection of trusted couriers to deliver furniture and accessories across the UK.

Deliveries to the Scottish Highlands, UK Islands and Europe may incur an additional charge. For these areas please contact us for an accurate delivery quotation.

Longer lead times

Delivery dates for items with longer lead times will be arranged over the phone. It usually takes around 2 weeks for most furniture items to be delivered but do remember to check the product page for delivery lead times. After a delivery date has been agreed, you will receive a text message and email confirming the date along with a delivery time. On the day of delivery, our friendly drivers will call you when they are 30-60 mins away. Our drivers are a trained furniture delivery team who will accommodate your delivery needs including delivery to room of choice - even if that's upstairs.

Deliveries and communications

Once you have placed your order you will receive a confirmation email listing the goods that have been ordered along with your delivery address and order number. If you have placed your order via the phone we recommend that you check your order confirmation to ensure all the details are correct.

If you have ordered an item with lead time of 'express delivery or in stock' we will contact you the next working day to arrange delivery. For the majority of in stock products, delivery time will be within 5 working days.

We will keep you up to date with orders that have long lead times or those that are currently out of stock. All delivery lead times are listed on the product page.

Order amendments

Most orders can be amended before dispatch; orders must be amended via email to sales@thebedshopleicester.co.uk

Made to order items can only be amended before they have been put into production - usually 5 working days.

You can amend your delivery address up to 24 hours before your delivery date.
